Housing board intercedes on homeowners’ association dispute

ANGELES CITY — The Housing and Land Use Regulatory Board (HLURB) has interceded on the dispute of homeowners at the Timog Park Homeowners Association Incorporated (TPHAI) here.
In a letter dated December 29, 2011, HLURB officer-in-charge Dunstan T. San Vicente stated that the agency “cannot formally sanction and/or recognize the result of the election conducted last December 6, 2011” where a certain Robert Lewallen allegedly won as president of the homeowners association (HOA).
San Vicente stated this in a letter addressed to Lewallen, who requested the HLURB to direct the old TPHAI officers headed by Pancho Coronel, to turn over the books, assets, and records to the newly elected board of directors and officers of the association.
Lewallen is also requesting the HLURB to deny the motion of the old officers to declare the HOA election on December as a failure.
San Vicente said the election of the association is shrouded with controversy and internal dispute involving separate actions by the election committee and the incumbent officers and directors of the association.
The HLURB official noted that the agency has a pending order dated November 29, 2011 instructing Coronel and other officers and directors to hold its annual members meeting and election because the election committee only have one member.
Despite the HLURB order, some members of the homeowners association pushed through with the election.
As a result of this, Lewallen and his companions reportedly took over the HOA office on December 29, 2011.
Coronel claimed that Lewallen destroyed the lock of the office and started scrutinizing the association’s documents.
With this, Coronel and his fellow officers filed charges against Lewallen and his group.
Coronel said several association documents and HOA fee collection amounting P16,000 are missing.
On Saturday, Coronel and other officers however regained control of the office forced Lewallen to leave his post.
In an interview with local newsmen, Lewallen asserted that he and his companions are the duly elected and qualified officers of the HOA.
He claimed that there was no failure of election and members of the HOA followed the process as provided for under the association by-laws.
Lewallen also disclosed that the new set of officers was sworn in by Mayor Edgardo Pamintuan.
Coronel said they will continue holding their respective positions until the new officers are elected. (Reynaldo G. Navales)
