Senate asked: Vote based on conscience, evidence

The 23 senator-judges will vote on the three articles of impeachment on Tuesday, May 29.

The prosecution panel needs at least 16 votes in just one article of impeachment to secure a conviction. Only eight votes meanwhile are needed by Corona’s lawyers to have their client acquitted of the charges. Speaker Belmonte also said that as representatives of the people, senator judges should ensure a Judiciary that is “independent” and free from “personal ambition and personal greed.”“We want a Judiciary where no one can say anything offensive about our justices, because they truly live in the light of justice and integrity, and will willingly endure the harsh glare of public scrutiny, because they have nothing to hide,” he added. After the two first speakers for the prosecution zeroed in on Article II or Corona’s failure to truthfully disclose his statement of assets, liabilities and net worth (SALNs), Belmonte focused on the two other charges in the impeachment complaint. The House Speaker said the prosecutors have proven that “the highest magistrate of the land is willing to tip the scales of justice with his own hands, when it comes to the former President” referring to former President-turned-Pampanga Representative Gloria Macapagal-Arroyo. Arroyo appointed Corona as Associate Justice in 2002 and as Chief Justice in 2010.“When Mr. Corona handed down a TRO (temporary restraining order) effectively allowing Mrs. Arroyo to leave the country, the nation uttered a collective cry of outrage because the very spirit of public accountability was coming under attack – by no less than the Chief Justice, supposedly the highest embodiment of justice in the land,” he said. Article VII of the impeachment complaint accuses Corona of partiality in allowing the Arroyo couple to leave the country through the issuance of a temporary restraining order. The House leader also said that Corona’s partiality was evident when the Supreme Court reversed a final ruling in a case involving the Flight Attendants and Stewards Association of the Philippines. In Article III, Corona was impeached for his failure to a provision in the Constitution which requires members of the Judiciary to be of proven competence, integrity, probity and independence after flip-flopping in final and executory cases.“Your Honors, I stand as the voice of an institution that, together with yours, form the legislative branch of government. The Legislature crafts and passes the laws. The Executive enforces these laws. Of what use are our efforts to build a better future, if the head of the entire Judiciary interprets the laws through the crucible of partisanship, profit, and personal ambition?” Belmonte asserted.
